I wonder what has really happened here ,how could the land loosers not have known about the building ? And wouldn't a party wall agreement have shown details ?

What has most probably happened the property next door has been registered fairly recently with the border giving benefit to the plot to be built on. The neighbours are never informed so it goes on the record. Old deeds are needed to check, worst thing ever that deeds were dropped as land registry can be changed easily

could that have happened I wonder .

If you look online you can see that the new houses (semi detached) are equidistant on both sides of their neighbours and more interestingly if you look at the flats previously on the site, the path does look (and I appreciate this is not a scientific method) to be similar in width as now. From what I understand is that the path is owned by the developer but has a ROW with next door and all the builders did was build on part of that paROXth. What is not clear is why next door waited until the building was complete to complain.

What is not clear is why next door waited until the building was complete to complain.

They said the builder boarded up the passageway for safety to do the building. They didn't realise until the boarding came down. I think you see that in the old google maps picture.

They must have not used the passageway for two years.

As they stood by and let it be built they won’t get an injunction only damages
