jdfi, you are probably correct. I have just received a response from the LPA who say that their conditions are only advisory and not legally enforceable, the developer can come and go whenever he likes and make as much noise as necessary. I have to say I am disappointed that an uncooperative individual can do just what he likes without concern for the people he is impacting and am more than a little disappointed that my neighbours talk a lot but don't do much. C'est la vie?
