Question about TPO appeal.

We propose appealing a refusal by the council for works to a TPO tree.
Having studied the appeal form to the Planning Inspectorate I have a couple of questions.
1) Does the inspector only accept those documents that were submitted with the original application to the council or can additional supporting documents be sent to the inspector when appealing -providing they only relate to the same works as in the original application ?
2) Instead of the fast track procedure we may ask to be heard by the inspector for which the form states “...we will organise... a round table discussion.” However the form also states “no discussion about the merits of the case will take place during the site visit.” Does this mean a site visit will be made prior to the round table discussion ?
Any advice would be much appreciated.

Hi Roy

The Inspector,when determining a TPO appeal by way of the fast track process, will rely on the information you provided in support of your application, and the response/reasons for refusal of the local authority. No harm in trying to add extra information, but the planning inspectorate might not accept it. Speak to the inspectorate. They're reasonable, but sticklers for procedure.

The appeal site visit at an informal hearing/round table discussion takes place after the discussions. The purpose of the visit is for the inspector to see for themselves the tree and the site, not continue discussions on the merits of the case. However, you could bet your house that the inspector will have already made a visit to get a feeling for the site prior to the hearing.
