Property Owners - Legal Implications
Property owners
- are responsible for disposing of Foul Water (washing machines, toilet, basins, bath, etc.) and Surface Water (roof, drive and other surface areas) drainage from their property to a suitable outfall point without causing pollution or a nuisance.
- are responsible for the land drainage of their own land and for accepting natural flows from adjoining land.
- also have responsibilities towards neighbouring property, and whilst they have the right to discharge natural flows from their land to adjoining land, this should not be done in a negligent or wilful manner.
- have a responsibility to make satisfactory provision for drainage of their buildings and maintain their drains and sewers clear of obstructions. Their drainage system must not be in such a condition so as to be prejudicial to health, cause a nuisance or be so defective as to admit subsoil water.
These responsibilities are enforceable by the District Council under the Building Act 1984, The Local Government Act (Miscellaneous Provisions) 1976 and the Public Health Act 1961.
